If there IS a health risk, and it's in plain view, then she's alright to
enter the property, but from what I can tell there is no reasonable
suspision of a health risk from the video and him moving dirt. Now, if she
wanted to search inside the home or something like that then a court order
would be needed.

unless u have a warrant or some other kind of court order u can not enter
privately owned property. even suspected drug dealers have a right to deny
an officer admittance unto his property if the officer does not have a
court order.

Awesome video. As we can see here, his rights are clearly and openly
violated. Their responses clearly show they have no warrant OR probable
cause -- otherwise the deputy wouldn't have tried to reason with him. I
hope this is used to prosecute these "people."
Also, it's sad to see that typical American xxxxs are all the way in
Indiana. She should have been polite, left and gotten the warrant.
Instead, she just HAD to trample on his constitutional rights. This isn't
America anymore.
Both of them deserve the harshest possible sentence. The deputy should be
locked up and assraped on a daily basis, and the "woman" should have her
skull bashed in by other inmates when she (hopefully) goes to prison for
this.

"Government Official" without proper ID or a warrant and the cop says do
what ya want.......I thought proper identification was MORE strict after
9-11, my bad. I can't wear shoes through security checkpoints at airports
but if I get a little ID badge that doesn't even show my full name and say
I'm a "Government Official" apparently I can go on anyone's property I
want taking pictures of their house and land....in Indiana anyhow.

Actually the guy is wrong. He is clearly installing or modifying an illegal
septic system which if not properly installed can contaminate ground water
and present a public health threat. You better believe there are plenty of
instances where people can enter your property without a court order.

This guy was attempting to dig a septic and probably did not have a permit.
If you do not obtain a permit you have no rights since its a violation
because he could be putting the whole a lot of peoples health in jepordey.
Its clear to see that he has the plastic sweage tubing next to the loader
and this is what the investigator is taking pictures of.

From the information we have we don't know if what he was doing was illegal
or not. For all we know he does have all the proper permits, he may even
qualified to install a septic system if that is what he is installing. I
do disagree with the womans as well as the cops actions but a court would
be able to determine the proper course of action.
